Terms & Conditions

.

Last Updated: 10/06/2026

By accessing or using the Website, submitting a service request, or contacting us through the Website, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Website.

1. Description of Services

Atomic Roadside Rescue provides light-duty roadside assistance services in and around Rochester, Minnesota, subject to availability, location, vehicle type, safety conditions, and applicable service limitations.

Services may include:

  • Vehicle lockout assistance;
  • Emergency jump starts;
  • Flat-tire changes using the vehicle’s available spare tire;
  • Tire inflation;
  • Fuel delivery, including delivery of up to approximately two gallons where available;
  • Battery delivery;
  • Battery installation;
  • Minor light-duty roadside assistance and related services.

Atomic Roadside Rescue provides services for light-duty vehicles, including qualifying cars, vans, and light-duty trucks. We do not provide heavy-duty repair, heavy-duty roadside assistance, commercial truck repair, bus repair, or large-equipment repair.

A service request submitted through the Website does not guarantee that Atomic Roadside Rescue will be able to provide service. Service availability may depend on technician availability, weather, traffic, location, vehicle condition, required equipment, safety conditions, and the nature of the requested service.

2. Service Requests and Customer Information

When submitting a service request, you agree to provide accurate and complete information, including, as applicable:

  • Your name and contact information;
  • Your vehicle’s make, model, year, and location;
  • The type of assistance requested;
  • Any relevant safety, access, or vehicle information;
  • Information reasonably necessary to confirm that you are authorized to request service for the vehicle.

You are responsible for ensuring that the vehicle is located in a safe and accessible area whenever reasonably possible. You must promptly notify Atomic Roadside Rescue if the vehicle’s location changes or if the requested service is no longer needed.

Atomic Roadside Rescue may decline, delay, or discontinue a service call when the location or conditions are unsafe, unlawful, inaccessible, outside our service capabilities, or otherwise unsuitable for the requested service.

3. Booking, Cancellation and No-Show Policy

3.1 Booking Methods; Confirmation

You may book a roadside assistance appointment or request service by:

  • Phone; or
  • Our Website.

After you book, we will typically provide a booking confirmation (which may be by phone, text message, or email). A booking confirmation indicates we have received your request and have scheduled a service window, but it does not guarantee that service will be completed by a specific time or that service will be possible under all conditions.

3.2 Service Windows; Estimated Arrival Times

Appointments are generally scheduled within a service window, and we may provide an estimated arrival time (ETA). All arrival times and ETAs are estimates and may be affected by traffic, weather, road conditions, technician availability, and call volume. Delays may occur, and we appreciate your patience.

3.3 Required Information at Booking

When booking, you agree to provide accurate and complete information reasonably necessary to schedule and perform service, which may include:

  • Customer name;
  • Best contact phone number;
  • Vehicle make, model, year (and other identifying details as requested);
  • The vehicle’s exact location (address or nearest cross streets) and any access instructions; and
  • A description of the issue/service requested.

If the information you provide is incomplete or inaccurate, service may be delayed, rescheduled, or declined, and additional fees may apply as permitted by law.

3.4 Cancellation; No-Show Fee

If you cancel a booked appointment, a $30.00 cancellation fee will be charged. The cancellation fee applies regardless of the reason for cancellation unless waived by Atomic Roadside Rescue in its sole discretion.

If you are a no-show (including if we arrive within the service window and cannot reach you, cannot access the vehicle, or the vehicle is not present), the same $30.00 fee will be charged.

3.5 Rescheduling

If you need to reschedule, please contact us as soon as possible. Rescheduling is subject to technician availability and may result in a new service window and updated pricing based on time, location, and conditions. Atomic Roadside Rescue may treat late rescheduling as a cancellation or no-show when appropriate, including when a technician has already been dispatched.

3.6 Payment Terms; Accepted Payment Methods

Unless otherwise agreed in writing, payment is due as specified by Atomic Roadside Rescue at the time of service, at dispatch, or through the payment method provided by the customer. Accepted payment methods may include major credit/debit cards and other payment methods made available by Atomic Roadside Rescue from time to time. You authorize us (and our payment processor) to charge all applicable amounts, including service charges, taxes, and any applicable cancellation or no-show fee.

3.7 Conditions That May Delay or Prevent Service; Discretionary Waivers

Atomic Roadside Rescue may delay, reschedule, or decline service when conditions make service unsafe, unlawful, impracticable, or outside our service capabilities, including, for example:

  • Severe weather or hazardous road conditions;
  • Unsafe, restricted, inaccessible, or unlawful locations; or
  • Unsafe vehicle conditions or other hazards.

In such cases, Atomic Roadside Rescue may, in its discretion, waive certain fees (including cancellation or no-show fees) depending on the circumstances.

3.8 Refunds

Refund eligibility (if any) depends on the specific service, circumstances, and whether service was performed. If you believe you were incorrectly charged, please contact us using the methods listed in Section 28 (Contact Information). Any refunds, credits, or charge reversals are issued at Atomic Roadside Rescue’s discretion to the extent permitted by law and may be reduced by nonrefundable processing fees or amounts owed for services performed.

4. Pricing and Payment

Prices, fees, taxes, parts, fuel, battery costs, delivery charges, waiting-time charges, cancellation fees, and other applicable charges may vary based on the requested service, location, vehicle, time, conditions, and materials required.

Any estimate or quoted price is based on the information available when the estimate is provided and may change if the actual circumstances differ. Unless otherwise agreed in writing, payment is due as specified by Atomic Roadside Rescue at the time of service or through the payment method provided by the customer.

The Website may display general service information but does not necessarily establish a final price for a particular service call. The final price should be confirmed with Atomic Roadside Rescue before or during service whenever reasonably practicable.

4. Customer Responsibilities

You agree to:

  1. Remain available by telephone or other contact method provided to Atomic Roadside Rescue;
  2. Provide accurate information about the vehicle and service location;
  3. Confirm that you own, possess, or are otherwise authorized to request service for the vehicle;
  4. Follow reasonable safety instructions provided by Atomic Roadside Rescue personnel;
  5. Remove personal property from areas where service will be performed when reasonably possible;
  6. Disclose known vehicle defects, hazards, damage, modifications, security systems, or other conditions that may affect the service;
  7. Pay all applicable charges for services, parts, fuel, batteries, and other approved items; and
  8. Avoid directing or permitting any service to be performed in an unsafe or unlawful manner.

You are responsible for any additional charges resulting from inaccurate information, an inaccessible location, a change in service requirements, or conditions not reasonably apparent when the service was requested.

5. No Guarantee of Repair or Vehicle Operation

Roadside assistance is intended to provide limited emergency assistance and does not constitute a guarantee that a vehicle will start, operate safely, remain operational, or reach a particular destination.

Atomic Roadside Rescue does not guarantee that:

  • A jump start will resolve a battery or vehicle problem;
  • A battery installation will correct an underlying electrical or mechanical problem;
  • A tire change will make a damaged tire safe to repair or operate;
  • Fuel delivery will resolve a problem unrelated to an empty fuel tank;
  • A lockout service will be successful in every circumstance;
  • A vehicle will not sustain damage during a service call;
  • A vehicle will be safe to drive after service; or
  • A vehicle will not experience additional mechanical or electrical problems.

The customer is responsible for deciding whether a vehicle is safe to operate after service. When appropriate, you should seek inspection or repair from a qualified automotive repair facility.

6. Emergency and Safety Disclaimer

The Website and Atomic Roadside Rescue’s roadside assistance services are not a substitute for police, fire, ambulance, emergency medical services, or other emergency responders.

If you are experiencing a medical emergency, collision involving injuries, fire, immediate danger, criminal activity, or another life-threatening emergency, call 911 immediately.

For your safety, remain in a safe location whenever possible, use hazard lights, stay away from moving traffic, and follow instructions from law enforcement or emergency personnel. Atomic Roadside Rescue may be unable to provide service in locations or conditions that present an unreasonable safety risk.

7. Website Use

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Website in violation of any applicable federal, state, or local law;
  • Submit false, misleading, fraudulent, abusive, or unauthorized service requests;
  • Impersonate another person or misrepresent your identity or authority;
  • Interfere with, disrupt, damage, or place an unreasonable burden on the Website or its systems;
  • Attempt to gain unauthorized access to the Website, its servers, accounts, or related systems;
  • Introduce viruses, malware, malicious code, or other harmful material;
  • Use automated systems, scraping tools, bots, or similar technology without our prior written authorization;
  • Copy, reproduce, modify, distribute, sell, or exploit Website content without permission;
  • Use the Website to harass, threaten, abuse, or harm Atomic Roadside Rescue, its customers, technicians, contractors, or other persons; or
  • Use information obtained from the Website for unauthorized marketing, solicitation, or commercial purposes.

We may suspend or terminate access to the Website or decline service requests if we believe a user has violated these Terms or engaged in unlawful, abusive, fraudulent, or unsafe conduct.

8. Website Availability and Disclaimer of Warranties

The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Atomic Roadside Rescue disclaims all warranties, express or implied, regarding the Website, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and uninterrupted or error-free operation.

We do not warrant that:

  • The Website will always be available or accessible;
  • The Website will be secure or free from viruses or other harmful components;
  • Website content will always be complete, current, accurate, or error-free;
  • Defects or errors will be corrected; or
  • The Website will meet your particular needs or expectations.

Information on the Website is provided for general informational purposes and may be changed or removed without notice.

9. No Professional, Mechanical, or Legal Advice

Information provided through the Website is general information only and is not legal, medical, financial, insurance, engineering, or professional automotive advice.

Roadside assistance services are limited emergency services and are not a substitute for a complete mechanical inspection, diagnosis, or repair by a qualified automotive professional. You should consult an appropriately qualified professional for advice specific to your circumstances.

10. Independent Contractors and Service Providers

Atomic Roadside Rescue may use independent contractors or third-party service providers to perform or assist with service calls. These providers may carry their own insurance and may be responsible for their own tools, vehicles, taxes, licenses, permits, and business operations.

To the fullest extent permitted by applicable law, Atomic Roadside Rescue is not responsible for the independent acts, omissions, negligence, property damage, bodily injury, or other losses caused by an independent contractor or service provider, except to the extent responsibility cannot lawfully be disclaimed or limited.

Nothing in these Terms eliminates or limits liability that cannot legally be eliminated or limited under applicable law. Nothing in these Terms prevents a customer from pursuing rights or remedies that are nonwaivable under applicable law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Atomic Roadside Rescue and its owners, officers, employees, agents, technicians, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or related to:

  • Your use of or inability to use the Website;
  • A delay, interruption, cancellation, or failure to provide a service;
  • A service request submitted through the Website;
  • Vehicle damage, personal property damage, loss, theft, or diminution in value;
  • Personal injury or property damage arising from conditions outside Atomic Roadside Rescue’s reasonable control;
  • A vehicle’s preexisting condition, defect, modification, security system, or mechanical or electrical failure;
  • Actions or omissions of third-party providers or independent contractors; or
  • Reliance on information provided through the Website.

To the fullest extent permitted by law, Atomic Roadside Rescue’s total liability arising out of or relating to the Website or a service requested through the Website will not exceed the amount actually paid by the customer to Atomic Roadside Rescue for the specific service giving rise to the claim.

These limitations do not apply to liability that cannot be limited or excluded under applicable law, including any rights or remedies that are nonwaivable under Minnesota law.

12. Vehicle Damage and Personal Property

Before service begins, customers should disclose known vehicle damage, mechanical problems, security devices, modifications, or other conditions that may affect the requested service.

Atomic Roadside Rescue is not responsible for:

  • Preexisting damage or defects;
  • Damage resulting from the vehicle’s condition, design, age, modification, or failure;
  • Damage resulting from the customer’s instructions or failure to disclose relevant information;
  • Personal property left in or around the vehicle;
  • Damage caused by unsafe parking, traffic, weather, road conditions, or third parties; or
  • Damage or loss outside the reasonable scope of the requested service.

To the extent permitted by law, customers assume responsibility for personal property left in or around a vehicle during a service call.

13. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Atomic Roadside Rescue LLC and its owners, officers, employees, agents, technicians, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your breach of these Terms;
  • Your violation of applicable law;
  • Your unauthorized use of the Website;
  • Your negligent, intentional, fraudulent, or unlawful conduct;
  • Your failure to provide accurate information;
  • Your failure to follow reasonable safety instructions; or
  • Your claim that you were not authorized to request service for a vehicle or property.

This provision does not require you to indemnify any person for that person’s own liability to the extent such indemnification is prohibited by applicable law.

14. Intellectual Property

The Website and its content, including the Atomic Roadside Rescue name, logos, trademarks, service marks, text, photographs, graphics, designs, videos, software, and other materials, are owned by or licensed to Atomic Roadside Rescue and are protected by applicable intellectual-property laws.

Except as expressly permitted in writing, you may not copy, reproduce, republish, modify, distribute, display, transmit, sell, license, or create derivative works from Website content.

“Atomic Roadside Rescue” and related names, logos, and branding may not be used without prior written permission.

15. User Communications and Submissions

If you submit reviews, comments, suggestions, photographs, messages, or other materials to Atomic Roadside Rescue, you represent that you have the right to submit them and that they do not violate the rights of another person.

By submitting material, you grant Atomic Roadside Rescue a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, publish, display, distribute, and otherwise use that material for business, marketing, service, and operational purposes, subject to applicable law and our Privacy Policy.

Do not submit confidential information, payment-card information, passwords, or other sensitive information through an unsecured Website form unless specifically requested through an authorized and secure method.

16. Privacy

Your use of the Website is also subject to our Privacy Policy, available at [Privacy Policy URL]. The Privacy Policy describes how we collect, use, disclose, retain, and protect personal information.

The Privacy Policy is incorporated into these Terms by reference to the extent permitted by law.

18. Electronic Communications

When you contact Atomic Roadside Rescue electronically or submit a request through the Website, you consent to receiving communications electronically, including calls, text messages, emails, and other messages related to your service request, appointment, payment, or customer support, subject to applicable law.

Message and data rates may apply. You may opt out of nonessential promotional communications by following the instructions in the communication or contacting us at [Privacy or Customer Service Email]. Opting out of promotional messages may not prevent communications necessary to complete or administer a requested service.

19. Changes to These Terms

We may revise these Terms from time to time. Changes will become effective when posted on the Website, unless a later effective date is stated.

Your continued use of the Website after revised Terms are posted constitutes your acceptance of the revised Terms. You should review this page periodically for updates.

20. Suspension or Termination

We may suspend or terminate your access to the Website, refuse service, or cancel a service request at any time, with or without notice, when permitted by law, including when necessary to:

  • Protect customers, technicians, contractors, or the public;
  • Prevent fraud, abuse, or unlawful activity;
  • Address a violation of these Terms;
  • Protect the security or operation of the Website; or
  • Comply with legal or regulatory requirements.

Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

21. Governing Law

These Terms are governed by and construed under the laws of the State of Minnesota, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

Nothing in these Terms prevents the application of mandatory consumer protections or other nonwaivable rights available under applicable law.

22. Informal Dispute Resolution

Before filing a legal action, you agree to first contact Atomic Roadside Rescue in writing and provide a reasonable opportunity to investigate and attempt to resolve the dispute informally.

Your written notice should include:

  • Your name and contact information;
  • A description of the dispute;
  • The service request or transaction involved, if applicable;
